TERMS OF SERVICE

1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and Cookt, operated by Andrej Kurocenko ("we," "us," or "our") concerning your access to and use of Cookt (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.

2. DESCRIPTION OF SERVICE

Cookt is a web application that helps users organize their personal recipe collection. The Service offers Free and Pro plans, each with different AI usage limits. AI features are subject to monthly usage limits based on your plan. The Service includes:

  • Importing recipes via text, images, PDFs, and documents
  • AI-powered recipe extraction and formatting
  • AI-generated dish images
  • AI chat assistant ("Sous-chef") for recipe modifications
  • Recipe organization with tags and search
  • Recipe sharing features
  • Premium features available on the Pro plan (smart shopping list, weekly meal planning, and future premium features as they launch)

3. USER ACCOUNTS

To use the Service, you must create an account. You can sign in using Google (single sign-on) or a passwordless magic link sent to your email. You are responsible for:

  • Maintaining the security of your account and the email address associated with it
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. USER CONTENT

Your Recipes

You retain ownership of any recipes and content you upload to the Service. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Content Restrictions

You agree not to upload content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains malicious code or harmful content
  • Is fraudulent, misleading, or deceptive

5. AI-GENERATED CONTENT

The Service uses artificial intelligence to:

  • Extract and format recipe text from uploaded files
  • Parse structured ingredients (amounts, units, foods)
  • Generate recipe metadata (tags, cooking times, servings)
  • Generate dish images
  • Provide recipe suggestions and modifications via Sous-chef

We strive to make AI-generated content as accurate as possible, but it may contain errors. You are responsible for reviewing and verifying any AI-generated content before use, especially cooking temperatures, times, and allergy-related information. We cannot guarantee the accuracy, safety, or suitability of AI-generated recipes or cooking instructions.

6. ACCEPTABLE USE

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization

7. INTELLECTUAL PROPERTY

The Service, including its design, features, and content (excluding user-uploaded content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. PAYMENT AND SUBSCRIPTIONS

8.1 Plans

  • Free plan: €0, 7 AI recipe imports and 30 AI chat messages per month
  • Pro plan: €7/month or €69/year, 50 AI recipe imports and 300 AI chat messages per month, plus premium features (smart shopping list, weekly meal planning, future features as they launch)
  • Monthly limits reset on your billing date (anchored to account creation for Free, subscription purchase for Pro)
  • Unused credits do not roll over to the next period

8.2 Merchant of Record

  • All paid transactions are processed by Paddle.com Market Ltd ("Paddle"), who acts as our Merchant of Record
  • Your billing relationship for payment processing, invoicing, and tax compliance is with Paddle
  • By subscribing, you also agree to Paddle's Terms of Service and Privacy Policy

8.3 Billing & Renewal

  • Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled
  • You will be charged the applicable rate at each renewal
  • Paddle handles all payment processing, invoicing, and applicable taxes (including EU VAT)

8.4 Cancellation

  • You may cancel your subscription at any time via the Paddle Customer Portal (accessible from the Plan page in the app)
  • Upon cancellation, your Pro access continues until the end of the current billing period
  • After the billing period ends, your account reverts to the Free plan
  • No partial refunds for unused time within a billing period (see Refund Policy for full terms)

8.5 Downgrade Behavior

  • When Pro access ends (cancellation, non-renewal, or refund), your account reverts to Free tier limits (7 imports, 30 chats per month)
  • No data is deleted — all your recipes, tags, and organization remain intact
  • You can re-subscribe at any time to regain Pro access

8.6 Fair Use

  • Pro plan limits (50 imports, 300 chats) are generous fair-use caps
  • We reserve the right to adjust these caps with 30 days advance notice
  • If you consistently need higher limits, contact support@cookt.io

8.7 Price Changes

  • We may change pricing with at least 30 days advance notice
  • Existing subscribers keep their current price until their next renewal after the notice period
  • Continued use after a price change constitutes acceptance

8.8 Refunds

  • Refunds are handled according to our Refund Policy
  • Monthly plans: 14-day money-back guarantee
  • Annual plans: 30-day money-back guarantee

8.9 Free Plan Changes

  • We may adjust Free plan limits with reasonable notice
  • Significant changes will be communicated via email

9. TERMINATION

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. CHANGES TO TERMS

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. GOVERNING LAW

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
